well IRC is an internet relay chat. It's main purposeis to mainly.... chat... but you can also distribute files.

I would be upset if they do shut down the bittorrent and the irc file distribution systems, and I most certainly do not support that effort, but quite frankly I could see the justification in it, too.

I think it'd be wrong to shut down bit torrent when there are a multitude of perfectly legal files that can and are being shared in this manner. Should a handful of drunks cause the entire sport of football to be canned?

I am not sure. Personally, I'm not a big fan of piracy or even simply downloading anime or manga of online.

I might support it if they come up with a alternate solution. But for the time being I am nuetral.

Even if it is not available here, it's *still* illegal to distribute a copyrighted work. I believe the relevant treaty is the Berne ConventionSee Here , which requires signatory nations to protect the intellectual properties of other nations.

P2P can be legitimately used to share material you created or is public domain, but once you start sharing somebody else's work (music, show, etc) without their permisison, you break the law.

About the only exception I can see is if you own the original work. If you have the Japanese anime DVD, then you haven't deprived anyone of their royalties (you paid for it and are just getting a translation). This is what I do with scanlations-- get the original Japanese if I plan to go past a few pages.

Unfortunately, the drunks seem to be running wild at the stadium. To continue the metaphor, you don't have to cancel the entire sport just because of some drunks, but you would have to take some precautions to make sure they don't dominate and everything is done in a legal manner. If the stadium owner refuses, then the law has a duty to step in to enforce the law.

shutting down both would be impossible.

bittorrent is possible through torrents. theres no central server involved like Napster was. Plus, bittorrent is not all illegal content. It's also a good way to distribute large files (like one of the recent WoW patches, but that was a pain in the butt) without spending all the bandwidth.

Mirc would never be shut down. Same as bittorrent, there are tons of independant servers. And even if they did shut it down, there would be a huge backlash. There are a lot of legit things going on in irc. Shutting down irc would be like shutting down aol chatrooms or even the internet.

As far as fansubs being legal, i wouldn't quite go that far. It's a legal gray area. Technically, Japan still has full rights of that show and they could easily say "stop subbing our show".
